We are Risen Racing (Sole Proprietorship / Entreprise individuelle), operating as Risen Racing Official (“Company,” “we,” “us,” “our”). We are based in Switzerland.

We operate the website risenracingofficial.com (the "Site"), our Instagram account @risen.racing, as well as all related products and services that link or refer to these legal terms (collectively, the "Services").

Risen Racing Official sells limited-edition apparel, items, and collectibles in drops and collections throughout the year. Each item offered during a sale period is available only for a limited time and subject to stock availability.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Risen Racing, concerning your access to and use of the Services. By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time. The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

Our Content and Marks are protected by copyright, trademark, trade dress, and other intellectual property and unfair competition laws in Switzerland and worldwide.

The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to:

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

All registration and order information you submit is true, accurate, current, and complete;
You have the legal capacity and agree to comply with these Legal Terms;
You are not a minor in the jurisdiction in which you reside;
You will not access the Services through automated or non-human means (bots, scripts, scrapers, etc.);
You will not use the Services for any illegal or unauthorized purpose; and
Your use of the Services will not violate any applicable law or regulation.

4. USER REGISTRATION

You may be required to register with the Site to place orders. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine that such username is inappropriate, offensive, or objectionable.

5. PRODUCTS & AVAILABILITY

We make every effort to display the colors, features, specifications, and details of our products as accurately as possible. However, we do not guarantee that the colors, displays, or specifications will be entirely error-free, as electronic displays may vary.

All items are subject to availability, and we cannot guarantee that items will remain in stock. Due to the limited nature of our product drops, items are sold on a first-come, first-served basis. We reserve the right to discontinue any product at any time for any reason. Prices are subject to change.

6. PURCHASES AND PAYMENTS

We accept payment in the localized currency supported by your region at checkout.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and card expiration date. Sales tax / VAT will be added to the price of purchases as deemed required by applicable tax laws.

We reserve the right to refuse or limit any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order (including orders placed by resellers or unauthorized distributors).

7. CANCELLATIONS AND REFUND POLICY

All sales are final. Due to the limited nature and high demand of each item we sell, we do not accept returns or exchanges once an item has been processed and shipped.

Order Cancellations: If you wish to cancel an order, you must request a cancellation within two (2) business days of placing your order by contacting info@risenracingofficial.com. Cancellation requests submitted after this 2-business-day window cannot be guaranteed or approved.
Shipping Timeframe: Our standard processing and shipping timeframe is up to four (4) weeks. If an order has not been shipped within our standard 4-week processing period, you may request a full refund and cancellation by reaching out to info@risenracingofficial.com.

8. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. Unlawful use, commercial resale without authorization, automated purchasing (bots), and malicious activity on our website or social media channels (such as Instagram @risen.racing) are strictly prohibited.

9. GOVERNING LAW AND JURISDICTION

These Legal Terms and your use of the Services are governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or in connection with these terms, including the validity, invalidity, breach, or termination thereof, shall be subject to the exclusive jurisdiction of the competent courts of Switzerland.

11. USER GENERATED CONTRIBUTIONS AND LICENSE

The Services may invite or allow you to post, submit, publish, or transmit content (including text, reviews, photos, videos, comments, or media on our site or social media platforms such as Instagram @risen.racing).

By submitting or uploading any contributions, you grant us an unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license to use, copy, reproduce, display, perform, reformat, translate, and distribute your contributions (including your name, handle, likeness, or image, if included) for marketing, promotional, or commercial purposes across any media formats or channels.

You represent and warrant that your contributions:

Do not infringe upon any third-party intellectual property, privacy, or publicity rights;
Are not false, misleading, defamatory, obscene, harassing, or otherwise unlawful;
Do not contain unauthorized advertising, spam, or automated bot submissions.

We reserve the right, at our sole discretion, to monitor, edit, remove, or delete any user contribution at any time without prior notice.

12. SOCIAL MEDIA & THIRD-PARTY ACCOUNTS

As part of the functionality of the Services, you may link your account with third-party service accounts or interact with us on third-party social networking platforms (including Instagram @risen.racing).

You acknowledge and agree that:

Your relationship with any third-party social platform is governed solely by your agreement with that third-party provider.
We are not responsible for any content, security, or practices of third-party platforms.
You may disable the connection between our Services and your third-party accounts at any time.

13. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

Take appropriate legal action against anyone who violates the law or these Legal Terms;

WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES) TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.

16. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.

17. DISPUTE RESOLUTION

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms ("Dispute"), you and Risen Racing agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating any formal court proceedings. Such informal negotiations commence upon written notice sent by email to info@risenracingofficial.com.

If a Dispute cannot be resolved through informal negotiations, it shall be submitted to the exclusive jurisdiction of the competent courts of Switzerland, as specified in Section 9.

18. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

19. DISCLAIMER & LIMITATION OF LIABILITY

THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.

IN NO EVENT WILL RISEN RACING, ITS PROPRIETOR, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED UNDER SWISS LAW, OUR LIABILITY SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Right to Cancel and Refund: Risen Racing reserves the right, at its sole discretion, to cancel and fully refund any order at any time, for any reason or without prior explanation. Upon issuing a full refund, Risen Racing shall have no further liability or obligation regarding the canceled order.

20. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Risen Racing, its proprietor, partners, employees, and agents from and against any loss, damage, liability, claim, or demand (including reasonable attorneys' fees and expenses) made by any third party due to or arising out of:

Your use of the Services or purchase of products;
Your breach of these Legal Terms;
Any breach of your representations and warranties set forth in these Legal Terms;
Your violation of the rights of a third party, including but not limited to intellectual property rights.

21. USER DATA & ELECTRONIC COMMUNICATIONS

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

Visiting the Site, sending us emails, placing orders, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email or on the Services, satisfy any legal requirement that such communication be in writing.

These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement and understanding between you and Risen Racing. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision.

If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions.
